Dobbs v Jackson Women's Health Organization and Biden's July 8th Executive Order

On July 8th, Joe Biden announced an executive order in response to the Dobbs v Jackson Women's Health Organization Supreme Court ruling. Pro-abortion activists praised the administration's response to the Supreme Court ruling as they deemed his actions as a "protection of women's rights." However, ultimately, the role of the three branches of government and the impact of checks and balance prevents the Biden administration from imposing tyranny on the states.


What Is The Dobbs v Jackson Women's Health Organization Ruling?

The monumental case against abortion ultimately has been one of the most controversial cases in SCOTUS history. This decision overturned Roe v Wade and sent the decisions regarding abortion away from the federal government back to the states. This decision did not make a federal abortion ban within the United States; rather, it allowed the states to make decisions regarding the own state. The Supreme Court Justices ultimately believed that it was not in their power, as unelected officials, to make a decision that should have been originally with the states to begin with.

"Because the Constitution is neutral on the issue of abortion, this Court also must be scrupulously neutral. The nine unelected Members of this Court do not possess the constitutional authority to override the democratic process and to decree either a pro-life or a pro-choice abortion policy for all 330 million people in the United States. Instead of adhering to the Constitution’s neutrality, the Court in Roe took sides on the issue and unilaterally decreed that abortion was legal throughout the United States up to the point of viability (about 24 weeks of pregnancy). The Court’s decision today properly returns the Court to a position of neutrality and restores the people’s authority to address the issue of abortion through the processes of democratic self-government established by the Constitution." - Justice Brett Kavanaugh in his concurrent opinion


What Is In Biden's July 8th Executive Order?

In the executive order, Biden desired to expand access to abortion, specifically medication abortion, provide free/reduced care through the Title X clinics and Health Resources and Services Administration clinics, and promote awareness of contraceptive services. This also will lead to the creation of a federal government interagency task force to promote abortion to women. He also explained that there was a necessity to ensure that women with miscarriages and ectopic pregnancies were protected under the law. However, no pro-life legislation will go against a woman who experiences an ectopic pregnancy or a miscarriage in their efforts to remove an already deceased baby. There is a continuous misinformation by the Biden administration into the actuality of the pro-life legislation promoted by state legislators.


What Does An Executive Order Actually Do?

An executive order is a directive from the President of the United States regarding the operations of the federal government. Executive orders are not legislation. This order does not impact any of the legality within the states after the Dobbs decision. The only way that abortions could be legal nationwide would be through federal legislation. Ultimately, the only thing that this executive order does is allow the Health and Human Services secretary to report back to the White House on the states' actions following the overturning of Roe. Ultimately, the executive order by Joe Biden was useless in restoring the access of one to receive an abortion.


What Does This Actually Mean For America?

The executive vows to push an expansion of the federal government in relation to the abortion pill which ultimately has led many women to have complications, resulting in hospitalization. Nearly six percent of women who use the abortion pill will be hospitalized, over twenty thousand women each year. Ultimately, the pro-life community must continue to push to help women as they have done for years and push back against the administration's desire to expand access to the abortion pill, which will cut off blood and nutrition to the baby. However, in the case that one takes a RU-486 pill, there are available resources through the Abortion Pill Reversal which has over a sixty percent success rate.


Joe Biden's executive order did absolutely nothing to limit the states' laws against abortion. He had weeks to codify Roe after the leaking of the Dobbs opinion which he never did despite having 50 seats in the Senate, in addition to the vice president to break the ties, as well as 222 seats within the House of Representatives. The only reason that millions of the future generations in the United States are going to be born is because of the bravery of Justice Thomas, Justice Barrett, Justice Alito, Justice Kavanaugh, and Justice Gorsuch.
